Environmental Compliance
- Conducted internal investigation on behalf of one of the largest and oldest family- run specialty glass companies in connection with a wide-ranging environmental criminal investigation by EPA and the U.S. Attorney’s Office for the Northern District of Texas regarding alleged improper storage, transport and disposal of hazardous waste. Investigation involves activities and facilities in at least three states.
- Led internal investigation on behalf of an equipment manufacturer regarding the improper disposal of the company’s spent sand at an unauthorized landfill. Interfaced with TCEQ investigators and inspectors. Resulted in no criminal charges or enforcement action being instituted against client.
- Represented large international plastics producer in a water pollution investigation involving its Houston distribution division. Conducted internal investigation and successfully negotiated threatened felony criminal charges down to one strict- liability misdemeanor count, against the Houston division only (a subsidiary company), resolved with a small tax-deductible monetary contribution to an environmental coalition in the same geographic vicinity as the company’s Houston division. Misdemeanor charge ultimately dismissed under a pretrial intervention agreement.
- Represented multinational energy company (public company) headquartered in Houston, Texas in connection with grand jury investigation into LDAR (Leak Detection and Repair) monitoring and reporting and allegations of inaccurate and false measurements, data entry and reporting at one of its large refinery facilities. Assisted the client in gathering, reviewing and producing extensive records, documents and data in response to grand jury subpoena. Conducted extensive internal investigation and interfaced with government agents, investigators and prosecutors to respond to and address various factual, legal, regulatory and compliance Resulted in no criminal charges brought against client or any individual employee(s).
